4. Booking and Reservations

Clients can book services through our online platform or by contacting our office directly. All bookings are subject to availability and confirmation. Upon booking, a reservation fee may apply as specified during the booking process.

5. Payment Terms

Payments for services rendered are due upon completion unless otherwise agreed upon in writing. We accept various payment methods including credit cards, debit cards, and bank transfers.

5.1 Pricing

All prices are listed in pounds sterling (£) and are inclusive of VAT where applicable. Prices may vary based on the scope of work and specific client requirements.

5.2 Late Payments

In the event of late payments, Gardening Upminster reserves the right to charge interest on the outstanding amount at a rate of 4% per annum above the base rate from time to time.

6. Cancellations and Refunds

Clients may cancel services with at least 48 hours' notice without incurring any charges. Cancellations made within 48 hours of the scheduled service may be subject to a cancellation fee equivalent to 50% of the service cost.

6.1 Refund Policy

If a service is not performed to the client's satisfaction, Gardening Upminster will endeavor to rectify the issue. Refunds are issued at the discretion of management and are not guaranteed.

7. Client Responsibilities

Clients are responsible for:

Providing access to the property during scheduled service times.
Ensuring that the area to be serviced is free from obstructions and hazards.
Communicating any specific requirements or concerns prior to service commencement.

8. Liability

Gardening Upminster strives to provide high-quality services; however, we cannot be held liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services. Our liability is limited to the total amount paid by the client for the services in question.

9. Insurance

Gardening Upminster maintains adequate insurance coverage to protect against potential liabilities. Clients are advised to ensure that their personal insurance policies are up to date and provide adequate coverage for property and personal belongings.

10. Intellectual Property

All content, designs, and materials provided by Gardening Upminster are the intellectual property of Gardening Upminster and are protected by applicable copyright laws. Clients are prohibited from reproducing, distributing, or modifying any of our proprietary content without explicit written permission.

11. Confidentiality

Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of the Agreement. This obligation persists even after the termination of services.

12. Termination

Either party may terminate the Agreement with written notice under the following circumstances:

Material breach of terms by the other party
Insolvency or bankruptcy
Mutual agreement to terminate

Upon termination, any outstanding payments owed by the client must be settled within 14 days.

13. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from this Agreement will be subject to the exclusive jurisdiction of the courts in England and Wales.

14. Amendments

Gardening Upminster reserves the right to amend these Terms and Conditions at any time. Clients will be notified of significant changes through the provided communication channels. Continued use of services after amendments constitutes acceptance of the new terms.

15. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms and Conditions constitute the entire agreement between the client and Gardening Upminster, superseding any prior agreements or understandings, whether written or oral.

17. Force Majeure

Gardening Upminster shall not be liable for any failure to perform its obligations due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, pandemics, or governmental restrictions.

18. Feedback and Complaints

Clients are encouraged to provide feedback or raise complaints regarding our services. All concerns will be addressed promptly and professionally to ensure client satisfaction.

19. Privacy Policy

Gardening Upminster is committed to protecting client privacy. Personal information collected during service engagement will be used solely for the purpose of providing and improving our services, in accordance with our Privacy Policy.

20. Waiver

Failure by Gardening Upminster to enforce any part of these Terms and Conditions does not constitute a waiver of future enforcement of that or any other provision.

These Terms and Conditions are binding upon and inure to the benefit of the parties hereto and their respective successors and permitted assigns.
